به گزارش پایگاه خبری دیده بان البرز و به نقل از خبرگزاری میزان، دوازدهم آبان ماه امسال تعدادی از اغتشاشگران در اطراف آرامستان بهشت سکینه و کمالشهر کرج به بهانه شرکت در مراسم چهلم یکی از جانباختگان اغتشاشات با ایجاد ناآرامی و ریختن سنگ و چوب و نخاله‌های ساختمانی، اقدام به بستن آزادراه کرج – قزوین و اختلال در عبور و مرور خودروها، تخریب اموال عمومی و خصوصی و ضرب و جرح مامورین کردند.
در حوادث این روز، سیدروح‌الله عجمیان یکی از حافظان امنیت، بدون هیچ سلاحی به همراه تعدادی از مردم که به جهت انسداد آزادراه در ترافیک مانده بودند در حال کمک جهت رفع انسداد راه بود و در این حین به صرف اینکه لباس بسیجی بر تن داشت مورد حمله اغتشاشگران قرار گرفت و تعدادی از آن ها با قساوت و بی‌رحمی وی را به شهادت رساندند.
بلافاصله پرونده‌ای در دادسرای امور جنایی و جرائم خاص کرج تشکیل شد و بازپرس مربوطه، دستورات قضایی لازم را جهت شناسایی و بازداشت متهمان به اداره کل اطلاعات استان البرز صادر کرد. در این پرونده برای ۱۶ نفر از متهمان قرار جلب به دادرسی و کیفرخواست صادر و ۹ آذر جلسات دادگاه انقلاب اسلامی و دادگاه کیفری یک استان البرز برای رسیدگی به اتهام افراد دخیل در شهادت شهید عجمیان و حوادت آن روز آغاز شد.
در جلسات دادگاه متهمان صراحتا نحوه شهادت سید روح‌الله عجمیان را تشریح کردند و به نقش خود در این جنایت اعتراف کردند. همچنین تصاویر و اسناد مرتبط با این واقعه نیز در دادگاه به نمایش در آمد.
در بازسازی صحنه جرم، متهمان، نحوه قتل را بازسازی کردند؛ همچنین اظهارات و اقاریر صریح و متعدد متهمان مبنی بر ارتکاب جرائم و تشریح صحنه جرم، کشف آلات و ادوات جرم از متهمان، بازبینی تلفن همراه آن ها و کشف مطالب مجرمانه، تصاویر و فیلم های منتشر شده از روز حادثه مبنی بر نحوه به شهادت رساندن شهید عجمیان نیز تماما اتهامات متهمان را اثبات می کرد.
روایت محمد مهدی کرمی از روز شهادت شهید عجمیان در جلسه دادگاه
محمدمهدی کرمی، متهم ردیف اول پرونده، در جلسات دادگاه با تشریح کامل اقدامات خود در روز حادثه گفت: شب یازدهم آبان ماه بود که یکی از دوستانم به من پیام داد و گفت که فردا چهلم حدیث نجفی است و ما هم برای حضور در آن مراسم آماده می‌شویم، من هم قصد کردم که در این مراسم حاضر شوم. در روز ۱۲ آبان نزدیک ۱۱ صبح بود که به ترافیک اتوبان رسیدم. از ماشین پیاده شدم و با افراد حاضر در صحنه شعار دادم و به سمت مأمورین سنگ پرتاب کردم.
وی توضیح داد: در ادامه به سمت زیرگذر که رفتم مشاهده کردم که جمعی از افراد در آنجا تجمع کرده‌اند من هم به این جمع پیوستم و شنیدم که فردی فریاد می‌زند بسیجی بسیجی. در ادامه دیدم که بسیجی روی زمین افتاده و دو الی سه نفر بالای سرش ایستاده‌اند و با سنگ و چوب به سر و صورتش ضربه می‌زنند. هر کسی یکی دو تا مشت میزد و فرار می کرد.
کرمی بیان کرد: همینطور که شهید با دست خالی در حال فرار بود، سنگ، چوب و… به سمت او پرت می کردند و افرادی که وی را می زدند بالای ۳۰ تا ۴۰ نفر بودند. من هم دستم را سمت شانه راستش انداختم و او را چرخاندم و بعد با یک سنگ به سرش ضربه زدم. بعد با مشت سه ضربه به سرش وارد کردم. شهید را دیدم که زمین افتاده و در همین حالت یک نفر روی پهلو و دنده سمت راستش می پرید.
وی ادامه داد: بعد از اینکه اطراف شهید خلوت شد به سمتش رفتم و با پا یک ضربه به وسط پاهایش و دو ضربه به زانوهایش زدم. در همین حین یک فرد آمد و سه الی چهار ضربه چاقو به شکم و پهلوی شهید وارد کرد و بعد از اینکه چاقو را زد و از روی شکمش بلند شد من پاهای او را گرفتم و به سمت جلوی خاور روی زمین کشیدم که در همین لحظه کفش هایش از پاهایش در آمدند و با کفش شهید، دو ضربه به صورتش زدم و بعد یک ضربه با پای چپ به سر و گردن او وارد کردم.
گفتنی است در جلسات دادگاه، فیلم و تصاویر اقدامات محکوم علیه کرمی نسبت به شهید عجمیان نیز به نمایش درآمد.

سید محمد حسینی فرزند سید حسن، متهم ردیف دوم این پرونده که با چاقو، ضرباتی به شهید وارد کرده است، در جلسه دادگاه اقداماتش در زمان شهادت شهید عجمیان را تشریح کرد و گفت: من جزو آخرین نفراتی بودم که بالای سر شهید عجمیان آمدم، افرادی به او توهین می‌کردند و به وی لگد می‌زدند. من نیز چاقوی خود را دو مرتبه و به عمق دو بند انگشت به بدن شهید عجمیان فشار دادم و در مرتبه سوم کمی به داخل بدن وی وارد کردم.
در رابطه با اقدام جنایتکارانه محکوم حسینی در روز حادثه، دیگر متهمان پرونده نیز صراحتا وی را به عنوان فردی معرفی کردند که به شهید چاقو زد و با توجه به اینکه سیدمحمد حسینی در آن روز پیراهن قرمز به تن داشته حتی قبل از شناسایی و بازداشت وی، سایر متهمانی که قبل از او بازداشت شدند همگی اظهار داشتند کسی که لباس قرمز داشته چندین ضربه چاقو به شهید زده است.
محمدمهدی کرمی در دادگاه زمانی تشریح حادثه در حضور سید محمد حسینی گفت: یک فرد آمد و با سه الی چهار ضربه تقریبا به اندازه دو بند انگشت با چاقو به سمت ناحیه شکم و پهلو شهید ضربه وارد کرد.
قاضی از کرمی پرسید: چه کسی با چاقو به دنده شهید ضربه کرد؟ کرمی به محمد حسینی اشاره کرد و گفت: این فرد با چاقو به ناحیه شکم و پهلوی شهید ضربه زد.
تصاویر و فیلم هایی که از روز حادثه به دست آمده است نشان می‌دهد، متهم در زمان انسداد اتوبان تهران – کرج و زمان شهادت شهید عجمیان حضور فعال داشته و تصاویری از زمانی که سنگ در دست داشته نیز منتشر شده است.
در نهایت پس از برگزاری جلسات دادگاه، ختم رسیدگی از سوی دادگاه اعلام و در تاریخ ۱۳ آذر، احکام اولیه این پرونده صادر شد.
بر اساس احکام صادرشده اولیه محمدمهدی کرمی و سیدمحمدحسینی، به اتهام افساد فی الارض از طریق ارتکاب جرائم علیه امنیت کشور، حمله به مامورین حافظ امنیت و جنایت علیه تمامیت جسمانی افراد که موجب اخلال شدید در نظم عمومی و ناامنی در کشور و منتهی به شهادت سید روح الله عجمیان شد به اعدام محکوم شدند.
بر اساس این گزارش احکام صادره پس از اعتراض متهمان در دیوان عالی کشور مورد بررسی مجدد قرار گرفت و رای دیوان عالی کشور بعد از بررسی دقیق پرونده درخصوص فرجام‌خواهی متهمان پرونده شهادت عجمیان صادر شد.
با توجه به قرائن و مستندات موجود در پرونده، دیوان عالی کشور، فرجام‌خواهی محکومان محمدمهدی کرمی و سید محمد حسینی را وارد و موجه تشخیص نداد و حکم صادره شده از دادگاه را به استناد بند الف ماده ۴۶۹ قانون آیین دادرسی کیفری تایید کرد.
بر همین اساس و پس از طی تمام مراحل قانونی و تایید رای از سوی دیوان عالی کشور، حکم اعدام محکومان محمدمهدی کرمی و سید محمد حسینی صبح امروز اجرا شد.
