وی افزود: در هنگام رسیدگی بدوی، دادستان وقت به عنوان جانشین ولی دم تقاضای قصاص وی را مطرح و شعبه اول دادگاه کیفری یک استان البرز حکم قصاص را صادر و در دیوانعالی کشور نیز به تایید رسیده بود.
نوروزی با اشاره به بلاتکلیف بودن حکم قصاص در این پرونده متذکر شد: دادستان وقت درخواست تبدیل حکم قصاص نفس متهم به پرداخت دیه را ارائه داد که با موافقت معاون اول وقت قوه قضائیه به شرط پرداخت دیه همراه شد.
